Privacy and Personal Data Protection Policy

This Privacy and PD Protection Policy (hereinafter referred to as the Privacy Policy) sets out the rules and procedure for processing and storing the PD of the Site Users.
GENERAL
1.1. The use of the Site by the Subject means that it agrees to this Privacy Policy and the PD processing terms.
1.2. In case of disagreement with the terms of the Privacy Policy, the Subject must stop using the Site.
1.3. We do not verify the authenticity of the PD provided by the Site Subject.
SUBJECT OF THE PRIVACY POLICY
2.1. This Privacy Policy sets out the owner’s obligations regarding deliberate non-disclosure of PD provided by the subject (for example, when using the Site, receiving services from the Owner, making a request or complaint, subscribing to informational messages, searching for information by location, etc.).
2.2. The PD allowed for processing under this Privacy Policy may be provided by the Subject by filling out special forms on the Site or on paper and usually include the following information:
2.2.1. Last name, first name, patronymic;
2.2.2. Location.
2.2.3. Email address;
2.2.4. Postal address;
2.2.5. Mobile phone number;
2.2.6. Information obtained in telephone conversations/through the exchange of e-mails/through our website, through the exchange of information by other technical means, software, applications, including commonly used messengers, including its communication content and metadata;
2.2.7. Information that you enter when using the Site services;
2.2.8. Information about conducted payment operations, bank accounts, etc. (within the framework of payment procedures);
2.2.9. Taxpayer’s registration card number (if any);
2.2.10. Any other personal information that you send to us to receive training services;
2.3. The Site administration also makes efforts to protect the PD, which are automatically transmitted during the visit of the site pages, namely:
IP address;
cookies data;
browser data (or other program that accesses the Site);
access time;
information about visited page addresses;
address of the previous page, and so on.
2.4. The Site collects statistics on the IP addresses of the Site subjects. This information is used to identify and solve technical problems, and to monitor the correctness of operations performed.
2.5. The category of the PD subjects hereunder is the Owner’s clients (including potential clients, Site visitors).
PURPOSES (OBJECTIVES) OF PERSONAL DATA PROCESSING
3.1. Purposes of PD processing:
providing services by the Owner and third parties acting under this Policy and directly involved in the organization, conduct, advertising and marketing campaigns and provision of services within the framework of their business activities and in a due manner;
ensuring compliance with laws and other regulatory acts;
information support of the Subjects who have provided their PD in any way, including by providing their PD through the Site;
maintaining communication with Site Subjects;
sending information (messages) to the e-mail, phone number, postal address, etc. specified by the Subject, including by sending service, advertising and news mailings; establishing feedback with the Subjects;
for marketing purposes;
service of requests and inquiries;
providing the Subject with effective client and technical support in case of any problems related to the Site use;
determining the location of the Subject for entering relevant information in document templates.
3.2. The Subject shall provide the PD to the extent necessary to achieve the purposes.
TERMS OF PERSONAL DATA PROCESSING
4.1. The PD of the subject of the PD shall be processed without time limit, in any legal way, including in the PD information systems with or without using the automation tools.
4.2. The Subject agrees that the Owner shall have the right to transfer the PD to third parties, in particular, law enforcement, controlling, local authorities, regional state administrations and other state and local bodies in cases and on the grounds determined by the current legislation.
4.3. The Subject agrees that the owner shall have the right to transfer the PD to third parties, contracting parties of the Owner, with whom the relevant agreements have been concluded, on the basis of which such persons have the right to use training materials, video courses of the Owner in their business activities.
4.4. The Subject’s PD may be transferred to the authorized state bodies only on the grounds and in accordance with the procedure established by the current legislation.
4.5. The personal information of the Subject shall be kept confidential, except in cases when the User voluntarily provides information about himself for public access to an unlimited number of persons.
4.6. If the Subject withdraws consent to processing of his PD, the Owner shall stop their processing if this does not contradict the legislation of Ukraine.
4.7. In case of conditions that may make it necessary for the Owner to change the PD, in particular their composition, the Owner shall make such a change by publishing a new version of the Policy on the Site. Such changes may include, in particular, but not exclusively, changes in the owner’s business activities, changes in the legislation of Ukraine, changes in the Site functioning.
4.8. The Owner shall delete and/or destroy the PD:
– based on a reasoned and legal request from the User;
– based on a reasoned and legal request from the competent state authorities;
– in case of termination of business activity by the Owner;
– in other cases and on other grounds defined by law.
The Owner shall delete and destroy the PD in a way that excludes the further possibility of updating such PD.
4.9. The owner’s accountant or other person who can provide accounting services to the Owner on a contractual basis, including, in particular, checking the correctness and completeness of the Owner’s settlements with his clients, may also have access to the PD of the Owner and the persons specified in this Policy. In this case, the Owner may give access for such a person to the Owner’s clients database.
4.10. The information about operations related to the PD processing and access shall be stored using automated systems. This system automatically records the specified information. This information shall be kept by the Owner for a year from the end of the year when these operations were performed, unless otherwise provided by law.
4.11. To ensure the PD protection, the Owner shall take reliable measures for such protection and, at all stages of their processing, in particular, uses modern software on which basis the Site has been created and with the help of which the PD is stored. Also, the Owner uses the PD in such a way that their use by third parties is carried out only in the necessary cases and on the grounds, in a manner and under the conditions determined by this Policy and the legislation. The PD protection includes measures aimed by the Owner to prevent accidental loss or destruction, illegal processing, including illegal destruction or access to the PD.
4.12. If it is found that the information about a person does not correspond to reality, such information must be immediately changed or destroyed.
4.13. The PD subject shall have the right to submit a reasoned claim to the Owner regarding the Prohibition of processing its PD (a part of them) and/or changing their composition/content. Such a request shall be considered by the Owner within 10 days from the date of receipt. If, based on the results of consideration of such a claim, it is revealed that the subject’s PD (part of them) is being processed illegally, the Owner shall stop processing the subject’s PD (a part of them) and inform the PD subject hereof. If, based on the results of consideration of such a request, it is revealed that the subject’s PD (a part of them) is unreliable, the Owner shall stop processing the subject’s PD (or a part of them) and/or change their composition/content and inform the PD subject hereof. If the claim is not subject to satisfaction, the Subject shall be provided with a reasoned response regarding the absence of grounds for its satisfaction.
4.14. The PD subject shall also have the right to withdraw consent to the PD processing without specifying reasons, if the only basis for processing is the consent of the PD subject. From the moment of the consent withdrawal, the Owner shall stop processing the PD.
4.15. In cases of unauthorized access to the PD, damage to technical equipment, or emergency situations, the owner shall immediately take all necessary and appropriate measures to eliminate such cases.
4.16. The Owner shall carry out regular training of employees engaged in the work with the PD, if employed.
4.17. The PD shall be accumulated in digital format with the use of the Owner’s software and hardware complex.
4.18. The PD shall be accumulated by the owner in paper format by keeping documents and other paper materials containing such PD in separate special folders.
OBLIGATIONS AND RIGHTS
5.1. The Subject shall be obliged to:
5.1.1. Provide correct and truthful information about the PD that is necessary for its processing purposes.
5.1.2. Update or supplement the provided information about the PD in case of change in such information.
5.1.3. Take measures to protect access to his confidential data stored on the Site.
5.2. The Subject shall have the rights granted by the current legislation of Ukraine.
5.3. The Owner shall be obliged to:
5.3.1. Use the received information exclusively for the purposes specified in this Privacy Policy.
5.3.2. Do not disclose the subject’s personal data, except for the conditions provided for in this Policy and current legislation.
DISPUTE RESOLUTION
6.1. All disputes shall be resolved by submitting a claim (a written proposal for voluntary settlement of the dispute) and providing a relevant response within 30 (thirty) calendar days from the date of receipt.
6.2. If it is impossible to resolve disputes through negotiations, the disputes shall be resolved in court in accordance with the current legislation of Ukraine.
6.3. The Subject and Owner shall be responsible for violating the terms of this Policy in accordance with the current legislation of Ukraine.
FINAL PROVISIONS
7.1. The Owner shall reserve the right to unilaterally amend this Policy. Amendments shall be made by posting a new version of this Policy on the Site. The new version of the Policy shall come into force from the moment it is posted on the site. The previous version shall become invalid from the moment the new version is posted on the site, unless otherwise provided by the new version of the Privacy Policy.
7.2. Issues not regulated by this Policy shall be resolved in accordance with the legislation of Ukraine and/or the legislation of the country in which you stay. You can withdraw your consent to the PD processing or make a reservation regarding the restriction of the right to the PD processing, get access to your used PD, make changes, delete your PD, refuse from receiving marketing messages and materials by sending a corresponding message to the email address Info@biggame24.com.
7.3. The PD distribution without the consent of the PD subject or a his authorized person shall be allowed in cases provided for by law, and only (if necessary) in the interests of the national security, economic well-being and human rights.
7.4. In any other cases, you will be informed about the need to disclose your PD to third parties (in this case, you can allow or prohibit the provision of your PD).
7.5. The owner may make certain changes and additions to this Policy from time to time without prior notice to users. If you do not refuse to accept them in writing, it will mean that you agree to the relevant changes. If, after reading the Privacy Policy, you have not informed us of your disagreement with it or your unwillingness to provide your PD, it shall be considered that you have accepted the terms of our Privacy Policy and have given us your consent to the collection, storage and processing of your PD.
